TAXELCO’S PRIVACY POLICY

1. INTRODUCTION

With the advent of new communication tools, it is necessary to pay special attention to the protection of privacy. That’s why at Placements St-Jérôme (hereinafter referred to as “Taxelco”), we take the confidentiality of our Users’ personal information (hereinafter defined) and compliance with applicable laws very seriously.

This Policy (hereinafter the “Policy”) is addressed to drivers, taxi drivers, passengers, and any other person using our services (hereinafter the “User” and “Users”). Its purpose is to describe the information we may collect from our Users in the course of our activities, the purposes for which we collect them, how we use them, and the circumstances under which we may disclose them to third parties. The Policy is designed to comply with Canadian laws regarding the protection of personal information and, where applicable, the General Data Protection Regulation (“GDPR”).

2. SCOPE OF THE POLICY

This policy applies to personal information that we hold or control, including information collected when using the Taxelco mobile application (“Application”), the web platform for corporate clients (“Platform”), or when browsing the Taxelco website (www.taxelco.com).

3. CONSENT

Your consent to the collection, use, or disclosure of your personal information must be clear, free, and informed. It should be given for specific purposes and in a way that you understand the nature, purposes, and consequences of collecting, using, and disclosing your personal information. Depending on the nature and sensitivity of your personal information, your consent can be explicit (such consent can be given orally, in writing, or electronically) or implicit (when you voluntarily provide personal information, for example).

Generally, we obtain your consent to collect, use, or disclose your personal information at the time of collection, unless otherwise required or permitted by law.

You can withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice. Please note that if you choose to withdraw your consent, we may not be able to provide you with certain services or features of the Application or Platform.

4. COLLECTION OF INFORMATION

By using our Application or Platform or browsing our website, you may be required to provide us with information, some of which may identify you. We may obtain this information, including when creating a User account (“Account”) and choosing a password or using the Application to explore various content and services.

The following information may be collected from Users of our Application, Platform, or website:

  • Name
  • First name
  • Email address
  • Phone number
  • Photograph
  • Employer, job, employee number if necessary for access to benefits offered to an organization
  • Details of trip requests and offers created on the Application
  • Frequency of using our services and transportation history
  • Interactions with us and other Users of the Application
  • Details of your visits to our Application and the content you accessed
  • Location data (when using the Application for managing or making trips)
  • A copy of your driver’s license
  • Information about your vehicle: registration, make, model, year of manufacture, vehicle color, or any other similar document that you have agreed to provide
  • Any other necessary information

Some personal information may also be collected through forms:

  • Application registration form
  • Platform order form
  • Job application form
  • Opinion survey
  • Contests
  • Others

Your information is also collected through interactions that may occur between you and the Application or our website and may be used for the purposes identified below. We may also collect feedback from other Users about their carpooling experience with you as part of the services we offer. This feedback is used for internal purposes only to ensure the quality of services and compliance with our policies.

Your personal information will not be kept longer than necessary for the purposes for which it was collected or used for other purposes.

Our Application, Platform, and website are designed for use by adults only.

5. AUTOMATICALLY SHARED DATA

In addition to the personal information identified below, we also collect certain information during exchanges between your computer or smartphone and our servers.

During each of your visits and use of our Application, we may collect, where applicable, information about the devices you use for our services or the networks from which you access our services (such as your IP addresses, connection data, types and versions of web browsers used, types and versions of your browser’s plugins, operating systems and platforms, the advertising identifier of your device), data about your browsing history, including your path on the various URL pages of our Platform or website, the content you access or view, search terms used, download errors, the duration of viewing certain pages, interactions with the page, and any phone number used to contact us, as well as your geographical location. Among the technologies used to collect this information, we use cookies.

We also collect information about your use of our Application and Platform (such as information about created trips, your response rate to messages, your registration date, your average ratings received, etc.) that may be displayed on your public profile.

All your information is securely stored on our servers. When you accept and confirm a trip with one or more Users, your geographical location may be shared with the other User to facilitate mutual location tracking.

Collecting such information allows us to improve the service, customize your experience, and better track our services and your requests.

6. USE OF YOUR PERSONAL INFORMATION

We may use your personal information to:

  1. Provide you with passenger transportation services, including electronic payment features.
  2. Establish, maintain, and manage our business relationship with you to provide personalized service.
  3. Process your requests and respond to your inquiries about the status of your requests.
  4. Communicate with you (by email, mail, or other means) and provide you with information about our products, services, surveys, contests, promotions, and special offers.
  5. Learn more about your preferences as a User.
  6. Conduct analysis, reports, statistics, market research, and studies to evaluate our customer service, measure our performance, enhance the experience we provide to our customers, and improve our service.
  7. Support research and development work to improve the performance of our tools (data used in this context is always anonymized).

7. SHARING OF PERSONAL INFORMATION

We acknowledge that, except as described below and unless allowed or required by law, sharing your personal information with a third party requires your consent.

In accordance with applicable laws, personal information about you may be disclosed to the following persons without your consent:

  1. Affiliated companies, present or future, of Taxelco.
  2. Our contractors and business partners, including our corporate clients and partner taxi companies, to the extent necessary for the purposes for which the information was provided or collected.
  3. A person or organization with the authority to compel the disclosure of information if required in the exercise of its responsibilities or functions, including to comply with a subpoena, warrant, or rules of procedure related to the production of documents.
  4. A person or organization responsible under the law for preventing, detecting, or prosecuting crime or law violations that need this personal information in the exercise of their functions and if this information is necessary for legal proceedings under applicable laws.
  5. A person to whom it is necessary to communicate information under applicable laws.
  6. Our representatives and advisors, including our accountants or legal advisors.

Access to your personal information within our company also does not require your consent but is strictly limited to individuals who need the information to perform their duties and responsibilities. Unauthorized consultation or communication of your personal information by an employee is strictly prohibited and could result in disciplinary action.

If a third party to whom we disclose personal information about you is in a foreign jurisdiction, the legislation in that jurisdiction may authorize the disclosure of your personal information to government authorities without your consent, for example, in response to a subpoena or legitimate court order as part of an investigation.

8. COMMUNICATION WITH YOU

If you have not provided explicit or implied consent, you will not receive any emails from us, except in special cases (e.g., follow-up or expiration of your subscription, participation in a contest, etc.), in compliance with the Canadian Anti-Spam Law.

To unsubscribe from our email communications list, simply contact us at info@taxelco.com. Be sure to provide your full name and the email address you used when you registered or made a purchase from us. Please note that there may be a processing delay, and you may continue to receive communications from us in the meantime.

9. THIRD-PARTY SERVICES

We use third-party services in managing our Application, Platform, or website. In no case can we be held responsible for any harm that may arise from these third-party services. To learn about the terms of use of these services, please refer to their respective policies. These third-party services include, but are not limited to, management software, analysis, payment, and email exchange.

10. RIGHT TO OBJECT AND WITHDRAW

We are committed to providing you with the right to object and withdraw your personal information.

The right to object means that Users have the option to refuse the use of their personal information for certain purposes mentioned during collection.

The right to withdraw means that Users have the option to request that their personal information no longer be included in, for example, a mailing list.

You also have the right to request access to the personal information we have collected about you and, if necessary, to correct it by contacting the contact person, whose contact information is provided in the “Contact Person” section below.

11. SECURITY

The personal information we collect is stored in a secure environment. We have taken appropriate measures to maintain the confidentiality of personal information and protect it against loss or theft, unauthorized access, disclosure, copying, use, or modification, taking into account their sensitivity and the purposes for which they are used. In addition, we require that each employee, agent, or representative complies with this Policy.

To ensure the security of your personal information, we use the following measures:

  • Network Monitoring Software
  • Computer Backup
  • Username/Password
  • Encryption of sensitive data (e.g., password)

We are committed to maintaining a high level of confidentiality by integrating the latest technological innovations to ensure the confidentiality of your transactions and protect your personal data from being viewed, used, or disclosed without authorization.

However, as no mechanism offers perfect security, there is always a risk when using the Internet to transmit personal information. If a password is used to protect your Account and personal information, it is your responsibility to ensure that it remains confidential.

14. PRIORITY

If an issue of definition or interpretation arises between the English and French versions of this Policy, the French version shall prevail.

15. MODIFICATION OF THIS POLICY

We occasionally update this Policy.

We reserve the right to modify or supplement this Policy at any time at our sole discretion. It is recommended to regularly consult this document, referring to the date of the last modification indicated at the bottom of the document.

If you object to any modification to this Policy, please discontinue your use of the Application and send written notice to us within 30 days of the effective date of the modification to cancel your contract with us.
